Terms of use
These terms of use (hereafter: ‘the terms’) concern the use of the platform denhaag.nl and all of its components (including forums) (subsequently: ‘the Platform’). By using the Platform, in any manner, you accept that you are bound to these terms. The municipality reserves the right to unilaterally change the terms. If you continue to use the Platform after a change in the terms, you automatically accept the changes.
Use of Platform
It is not permitted to post, publish and/or communicate content or information or to offer functionalities on and/or through the Platform if and insofar as this:
- is in breach of any applicable legal provisions
- infringes on any rights of a third party, in particular the intellectual property rights of this third party
- is in breach of reasonable instructions provided by the Municipality of The Hague
- is of a commercial nature
- is otherwise unlawful towards the municipality or a third party
With respect to publishing content as well as any other use of the Platform, you are expected to act and behave at all times as a careful user of the Platform. You will comply with all legal regulations as well as abide by the ‘netiquette’. And you will refrain from doing the things, which include but are not limited to: spamming, violating intellectual or industrial property rights of third parties and/or the Municipality of The Hague, publishing or disseminating (child) pornography, sexual intimidation or harassment of people in any other way, violating the privacy of third parties or tarnishing the name or good reputation of others, hacking, carrying out DoS attacks and other kinds of attacks as well as spreading viruses, worms and other programmes which can cause damage to individual systems or disrupt the operation of the internet in itself.
The municipality reserves the right to shorten or edit your contributions. It also reserves the right to delete contributions from the Platform. This could happen in the following cases:
- the contribution concerned violates the rights of the Municipality of The Hague and/or third parties
- the contribution concerned can cause damage to yourself, to third parties or to the Municipality of The Hague in some other way
- the contribution concerned is in breach of the rules for posting contributions as described in these terms.
Login details
In order to post comments on the Platform, a one-time registration may be required. Your personal information will be processed in accordance with the municipality’s privacy statement.
You ensure the municipality that the information you provide – including personal information such as name and email address – is complete, truthful and correct. You are responsible for keeping the password for your account confidential and you will not grant others access to the Platform using your account. You are liable for all consequences as a result of others using your account.
Uploading content/licence
You keep the copyrights and other intellectual property rights which belong to you with regard to content you post on the Platform.
You agree that, by making content, files, data and/or materials available to the Municipality of The Hague, you grant the Municipality of The Hague an unencumbered, irrevocable, worldwide, non-exclusive licence to use, duplicate, disseminate and publish the content in relation to the Platform.
You agree that the content you post on the Platform may be used by other users of the Platform. The municipality accepts no liability whatsoever for compliance with these terms by users of the Platform.
You ensure the municipality that you are the rightful owner of the content posted by you, and you indemnify the Municipality of The Hague against all claims by third parties based on the assertion that the content would violate any (intellectual property) rights of third parties or would be unlawful towards third parties in any other way.
Termination participation
At all times the municipality is authorised without giving any reason to temporarily or permanently freeze and/or remove your account, delete content, refuse to provide you services and/or block the access to those services, in particular – but not limited to – if:
(i) you act in breach of these Terms;
(ii) the municipality is of the opinion that your actions may cause liability issues or damage to yourself, to third parties or to the Municipality of The Hague.
Intellectual property rights
You acknowledge and agree that the Platform contains files, content and programmes which are the property of the municipality, its licensors and/or users of the Platform and which are protected by applicable intellectual property rights including but not limited to copyrights, database rights, neighbouring rights, trademarks and patents.
Use of images on the Platform
It is not permitted to re-use photographs and images from the Platform.
Liability
The information on this Platform is only intended as general information and for general use. No rights can be derived from the information. The Municipality of The Hague is not liable for any damage which has arisen or may arise as a result of (in)direct use of incorrect, outdated or incomplete information on this Platform, including – but not limited to – actions performed by a visitor to the Platform which are prompted by the information posted on the Platform.
Rules for social media
You are welcome to leave comments on the municipality’s social media platforms. However, you must abide by the rules:
- Treat each other with respect. The municipality does not tolerate aggression, (sexual) intimidation or discrimination.
- Respect each other’s opinion and privacy.
- Do not post any personal information about yourself or others on a public platform. Use a private message for this.
- It is not permitted to post photos or videos of an individual person or municipal employees with malicious intent.
- Messages which contain spam or which promote products or services are not permitted.
The municipality will be forced to delete the message/comment if these rules are violated. The municipality will (temporarily) block your account in the event of ongoing transgressive and inappropriate behaviour.
The Municipality of The Hague uses the social media planner Coosto. It is in the public interest to provide information to citizens through social media platforms. The social media content complies with GDPR requirements. (GDPR is General Data Protection Regulation.) For social media advertising the Municipality of The Hague may use (re)targeting to inform as many residents as possible about municipal policy goals, products and services.
Other provisions
Dutch law is applicable to these conditions. Any disputes arising from this agreement will, to the exclusion of all other courts, be brought before the competent court in The Hague.
